Plant Variety
Rights (PBR) provide a legal defence for a plant variety similar to a plant
patent (PBR). The Plant Patent Act makes it possible for new varieties of
asexually reproducing plants to receive patent protection. For this programme,
a plant variety must be different and one of a kind, with information on how it
was developed, found, or reproduced. The Indian government introduced the Plant
Variety Protection and Farmers’ Rights (PPVFR) Act in 2001.
The period
during which a registered variety is protected varies depending on the plant.
For example, trees and vines are protected for 18 years after the variety’s
registration, existing varieties are protected for 15 years after the Central
Government notifies the public of the variety under the Seed Act of 1966, and
other crops are protected for 15 years after the variety’s registration.
Plant Variety
Rights (PVR) give the applicant an exclusive commercial license to use brand
new or distinctly unique types of plants they create. This includes rights to
distribution, sales, royalties, and production of said plant variety.
