Renewal and Maintenance
The patent renewal process starts
after the grant of a patent. After the second year of patent filing, the first
renewal fee must be paid online. This is irrespective of the year of grant, the
renewal fee is paid after the grant but from the second year onwards. The
patent renewal fee is to be paid till the validity of the patent i.e. 20yrs
from the date of filing.
Example: The fifth-year renewal
fee must be submitted before the fourth year following the date of the patent
expires. At the end of the second year following the date of the patent, as
well as each successive year, a renewal fee is due. According to the Indian
Patents Act, the patentee may even pay the renewal cost in advance for 2 years
or more.
Another crucial thing to keep in mind is that
pending fee payment must be made within three months of the patent grant date,
as recorded in the patent register, is if patent is grants more than two
years after the application was filed.
In order to request pay of the renewal fee, the
patentee must provide the appropriate patent number, the date of the patent,
and the year for which the renewal price is being paid.
The main point of the entire Indian patent renewal
procedure that the renewal charges must be submitted before the start of each
new year. However, by submitting a request for an extension of time and the
required penalty fees, such term is extendable by six months.
If the patent is filed in the year 2023 the fees due
after the grant will be as follows for a natural person/Start-up/Educational
